Barbara M. Szweda, J.D., Associate Professor Law at LMU – Interpreters in Immigration cases Familiarizing court interpreters with the different venues in which interpreters are essential to immigrants seeking to regularize their status in the United States. This presentation will cover a general overview of the immigrants’ different interactions with Department of Homeland Security personnel, as well as the Immigration Court, and how the interpreter can and does play an essential role in giving immigrants access to justice in the immigration context, including examples of good and questionable interpreting.
Jeremy Jennings, Esq., Immigration Attorney, Knoxville – Immigration 101
This session will explain non-immigrant visas and immigrant visas, review the “alphabet soup” of the different visa types, differentiate between visa and immigration status and briefly delve into the complex area of unlawful presence. Participants will gain basic terminology and use documents for sight translation.
Jeremy Jennings, Esq. – Unauthorized Practice of Law and Immigration Reform
This session will explore the definition of the Unauthorized Practice of Immigration Law (UPIL) and undertake a case study of an immigration application to highlight dangers for interpreters. We will also review state and federal efforts and procedures to report and prosecute UPIL. Finally, we’ll briefly discuss the status of immigration reform.
Afternoon: Mock Trial Exercise: Participants will gain practical experience interpreting a series of short hearings conducted by the Duncan School of Law’s Mock Trial Team, led by Mr. Barry Carrier. Members of the mock trial team will present argument and examine witnesses based on factual patterns drawn from typical court proceedings, such as bail, deportation, preliminary and evidence suppression hearings. Interpreters will interpret the hearings on behalf of one or more of the parties involved in the hearing.
